Is Topless Sunbathing Allowed on Bali's Beaches?

No. Topless sunbathing is not allowed on Bali's public beaches, and there is no official nudist or topless beach anywhere on the island. Bikinis are fine on the sand; removing your top in public can fall under national criminal law, not just local etiquette. Rules below were checked in October 2026.

What is the legal basis?

Three layers of rules apply at the same time:

  • Indonesia's new Criminal Code (Law No. 1 of 2023), in force since 2 January 2026. Article 406 sets up to one year in prison or a fine of up to category II (Rp10 million) for violating decency in public. The official elucidation defines this as displaying nudity in a way that conflicts with the values of the community at that place and time.
  • Law No. 44 of 2008 on Pornography. Article 10 bans exhibiting yourself in public in a way that depicts nudity; Article 36 sets penalties of up to 10 years in prison and/or a Rp5 billion fine. It is rarely used for minor cases, but it is on the books.
  • Bali Governor's Circular No. 4 of 2023 on conduct for foreign tourists, updated by Circular No. 7 of 2025 (24 March 2025). It requires foreign visitors to dress modestly, reasonably and appropriately at sacred sites, tourist attractions, public places and during any activity in Bali, with firm action under Indonesian law for violators.

Foreign nationals face a fourth layer: immigration. Article 75 of Law No. 6 of 2011 on Immigration allows deportation and entry bans for foreigners judged to endanger public order or disregard the rules.

Has anyone actually been punished?

For public nudity, yes. In May 2022 Bali Immigration deported and blacklisted a Russian couple who took nude photos at a sacred Kayu Putih tree in Desa Tua, Tabanan, and posted them on Instagram (reported by ANTARA on 7 May 2022). The legal basis was Article 75 of the Immigration Law. We found no verified case involving topless sunbathing on a beach specifically, so don't read that as "safe". The pattern is that enforcement usually starts with a complaint from residents or a viral post, not with routine patrols.

What about a quiet, empty beach?

Still not allowed. The law makes no distinction between busy and empty beaches, because Indonesian beaches are public space. In Bali it is more sensitive still: many beaches sit next to temples, villagers use them for melasti and melukat ceremonies, and fishermen or locals can appear at any moment. You may occasionally see someone topless on a remote stretch, but that is an unreported violation, not a tolerated exception.

Beach clubs and hotel pools?

Beach clubs and hotels are licensed businesses open to guests, so they still count as public places. Their house rules are strict too. Café del Mar Bali, for example, states in its venue policy that proper swim attire must be worn in the pools at all times. Staff will usually warn you first and can then ask you to leave. We found no beach club or hotel in Bali that officially permits topless sunbathing.

A private villa pool?

An enclosed villa pool that cannot be seen from outside is not "in public", so the risk is much lower. Two caveats. Villa staff (housekeeping, breakfast delivery) often walk in with little warning, and many villas in Canggu or Ubud are visible from a neighbour's upper floor or from the rice fields. If in doubt, assume you can be seen.

And bikinis and swimsuits?

Bikinis, including fairly skimpy cuts, are normal on the beaches of Kuta, Seminyak, Canggu and Nusa Dua and at hotel pools. Problems start when swimwear is worn away from the beach, such as in a minimarket, a warung or on a scooter. We cover that separately in our article on wearing a bikini away from the beach in Bali.

Staying on the right side of the rules

  • Keep a bikini top or full swimsuit on at every public beach, including ones that look deserted.
  • If a ceremony is taking place on the beach (rows of people in white, offerings, gamelan), move away and cover up with a sarong or T-shirt.
  • To minimise tan lines, choose a thin-strap or strapless top; that is the accepted limit.
  • At beach clubs, read the dress code on the venue's official website before you go.
  • Do not take or post nude photos at tourist sites, temples or sacred trees; posts like that triggered the 2022 case.
  • If staff, police or pecalang (village security) ask you to cover up, do it and apologise. Arguing that "it's legal back home" only makes things worse.

If you come from a country where topless beaches are normal, the simplest approach is to treat all of Bali like a family beach: top stays on, sarong always in the bag.
