Yes. No rule in Bali requires hotels to ask for a marriage certificate, and the adultery and cohabitation articles in Indonesia's new Criminal Code can only be prosecuted if a complaint comes from the spouse, a parent, or a child of one of the partners. Police, hotel staff, neighbours, or community groups cannot start a case. Everything below was checked in September 2026 against the text of Law No. 1 of 2023 on the Criminal Code (KUHP), statements by the Minister of Law, and the Bali Governor's official release.
What do the articles actually say?
The national Criminal Code (Law 1/2023) took effect on 2 January 2026, replacing the Dutch-era code. The two articles travellers ask about:
- Article 411 (adultery): sexual intercourse with someone who is not your husband or wife. Maximum penalty of 1 year in prison or a category II fine, which is up to IDR 10 million.
- Article 412 (cohabitation): living together as husband and wife outside marriage. Maximum penalty of 6 months in prison or a category II fine.
Law No. 1 of 2026 on Criminal Penalty Adjustment, which took effect at the same time, amended a number of KUHP articles, but the published list of changes does not touch these two.
Who can file a complaint?
Both are absolute complaint offences. A case can only proceed if the complaint comes from:
- the husband or wife, for a person who is married;
- a parent or child, for a person who is not married.
The complaint can also be withdrawn as long as the court hearing has not started. Minister of Law Supratman Andi Agtas confirmed this to CNA Indonesia on 6 January 2026, a few days after the code took effect. For foreign tourist couples this makes the legal risk very small: your parent or legal spouse would have to come forward and file a formal report with the Indonesian police.
What does the Bali provincial government say?
In an official release on 11 December 2022, Bali Governor Wayan Koster stated three things: no marital-status checks (sweeping) by law enforcement, no marital-status checks at check-in at tourist accommodation, and guaranteed confidentiality of guest data. The statement has never been withdrawn, and Koster is serving another term as governor for 2025-2030. As far as media reports show as of September 2026, no foreign tourist in Bali has been prosecuted under Article 411 or 412.
Will the hotel ask about your relationship?
Star-rated hotels, villas, and guesthouses in Bali's tourist areas ask for a passport or Indonesian ID card to register, not a marriage certificate. For foreign guests, those passport details are reported to immigration through the foreigner reporting app (APOA). That is for immigration monitoring, not relationship status. A double bed for two different surnames is routine at reception.
The exceptions come from house policy. Sharia-concept hotels, and some small lodgings with mostly domestic guests, may turn away Indonesian couples who cannot show proof of marriage. That is their own rule, not a legal requirement. If you are an Indonesian couple, read the property's terms before booking.
So who actually needs to be careful?
The real risk is higher for Indonesian or mixed couples whose families live in Indonesia and object to the relationship, because they are the ones entitled to complain. Article 412 is also framed around "living together", so renting a house or boarding room together long term is more relevant than a week's holiday. Checks on newcomers in boarding houses by customary villages or the municipal police (Satpol PP) target residency paperwork, not marital status.
Which rules are actually enforced on tourists?
What more often ends in a warning or deportation is behaviour in public: skimpy clothing at temples and on the street, overt intimacy at holy sites, or nude photos at sacred locations. Bali Governor's Circular No. 7 of 2025 lists those obligations and prohibitions; a summary is in Bali rules for tourists. For how far swimwear can go away from the beach under the new code's decency article, see can you wear a bikini away from the beach.
Do you need to bring any special documents?
No. What hotels and officials check is a passport with a valid stay permit, such as an e-VOA or another visa, not proof of your relationship. Make sure the name on the booking matches your passport exactly, because spelling mismatches cause more trouble at reception than marital status ever does. Private villas booked through apps must also register foreign guests, so have your passport ready even when there is no front desk.
How should you choose where to stay?
International resorts and hotels in Seminyak, Nusa Dua, Ubud, or Uluwatu are the most relaxed choice because they are used to guests from every country and culture. If you want that kind of hotel at a lower price, the partner hotels on AccessiaPass are a good place to start.
One small thing people forget: list the second guest's name on the reservation. Hotels calculate rates, breakfast, and insurance by the number of registered guests, so this is about room administration, not morals.
