A foreign tourist who hits or injures someone in Bali is prosecuted under the same Criminal Code as locals: assault carries up to 2 years 6 months in prison, rising to 5 years if the victim is seriously injured (Article 466, Law 1/2023). Once the criminal case is over, Immigration usually follows with deportation and an entry ban.
What happened in Pecatu?
At 02:25 on Tuesday, 27 October 2026, two Saudi Arabian men identified as AMA (29) and FMA (35) stabbed three people outside a nightclub in Pecatu village, South Kuta. Bali Police spokesman Kombes Ariasandy told detikBali the pair had been removed from the club for bothering other guests, then argued with ride-hailing drivers waiting for orders outside. Two ojek drivers and a hotel security guard suffered stab wounds to the stomach and back.
At a press conference on Thursday, 29 October 2026, Denpasar Police chief Kombes I Wayan Winaya said the men used folding knives smuggled into the club. Both had been in Bali on tourist stay permits since September 2026 and are charged under Article 466(2), with a maximum of 5 years. Police scheduled urine tests and are coordinating with the Saudi embassy. The victims are stable and receiving outpatient care.
Which articles can be used?
Indonesia's new Criminal Code (KUHP, Law 1/2023) has applied since 2 January 2026. The texts below were checked on 30 October 2026; other changes are summarised in our new KUHP guide for tourists.
- Minor assault (Art. 471): a blow that does not make the victim ill or unable to work. Up to 6 months or a category II fine (IDR 10 million).
- Assault (Art. 466(1)): up to 2 years 6 months or a category III fine (IDR 50 million). Serious injury: 5 years. Death: 7 years.
- Premeditated assault (Art. 467): up to 4 years, or 7 years with serious injury.
- Joint public violence (Art. 262): applies if you and friends gang up on someone. Up to 5 years, 7 years if anyone is hurt, 9 years for serious injury.
- Taking part in a group brawl (Art. 472): covers everyone involved if the fight ends in serious injury or death.
- Carrying a bladed weapon (Art. 307): up to 7 years, charged separately from the assault.
What surprises many visitors: one punch that breaks a nose or a tooth can be classed as serious injury. Being drunk is no defence.
Will a foreign tourist be deported?
Almost always, after the sentence is served. Article 75 of Immigration Law 6/2011 lets immigration officers impose administrative action, including deportation and an entry ban, on foreigners who endanger public order or break Indonesian law. Since the 2024 amendment (Law 63/2024), a ban can last up to 10 years and be extended. More examples from this month are in our 10 deportation cases from October 2026.
Can it be settled out of court?
Sometimes, for lesser cases. The new Criminal Procedure Code (Law 20/2025) sets out restorative justice, generally for offences carrying up to 5 years and for first-time offenders. Supreme Court Circular 1/2026 confirms that offences with exactly 5 years still qualify. It requires an agreement with the victim, usually an apology and payment of medical costs. It is not automatic: investigators, prosecutors or judges decide, and the victim may refuse. Immigration can still act even when the criminal case ends in a settlement.
Never offer cash directly to an officer to make a case "go away"; that can become a bribery case of its own. If you have already been arrested, your rights to an interpreter, a lawyer and your consulate are covered in what to do if police detain you in Bali.
What if you are the victim or a witness?
- Move away from the scene first, then call 110 (police) or 112. If injured, go to the nearest emergency room.
- The forensic injury report (visum et repertum) is issued by the hospital at the police's request. It decides whether the injury counts as minor or serious.
- File a report at the SPKT desk of the local Polsek or Polresta (for Pecatu and Uluwatu, Polsek Kuta Selatan) and ask for the report receipt. Insurers want the same document, as explained in how to file a police report for insurance.
- Keep any video and note witnesses' names. Do not post the attacker's face online before reporting.
- If you are attacked and fight back, Article 34 of the KUHP covers necessary self-defence against an immediate unlawful attack. Your response must be proportionate, and investigators decide.
Staying out of trouble around clubs
Cases like Pecatu happen after 1 a.m., outside club doors, while drunk people wait for rides. If security asks you to leave, go, and book your car from inside the venue grounds. Do not get pulled into roadside arguments with drivers or other guests. Other duties and bans for visitors are listed on our Bali rules page.
FAQ
Can I be stopped from flying home while the case is open?
Yes. Immigration law allows a travel ban at the request of the police, and investigators can also seize a passport as part of the case. Budget for a longer stay.
Can a shouting match without punches lead to charges?
Rarely, unless it includes threats of violence or insults the victim reports. Shoving someone so they fall and get hurt already counts as assault.
What if the attacker is a local?
The process is the same: report to the Polsek, ask for an interpreter, and tell your consulate if you need support. Sources: detikBali, 28 and 29 October 2026; texts of Law 1/2023, Law 6/2011 and Law 63/2024, checked 30 October 2026.
